Ho v. Dosanjh, 2010 BCSC 845.
Mr. Ho was 35 years old, worked as an accountant, and had a goal of completing the Certified General Accountant (“CGA”) accreditation when his sustained injuries to his neck, jaw and headaches resulting from a rear-end motor vehicle collision in 2006.
ICBC focused on the fact that Mr. Ho had similar injuries from an earlier accident in 1998, he continued to utilize chiropractic treatment in the years since that 98 accident, and ICBC alleged that he did not suffer any new injuries in the most 06 accident. ICBC ignored the medical evidence that Mr. Ho was vulnerable due the injuries in the 98 accident, he suffered significant injuries in the 06 accident that impacted his ability to work long hours, and he was incredibly motivated and diligent in pursuing his rehabilitation and maximizing his recovery.
ICBC offered $75,000 shortly before trial and denied that Mr. Ho suffered any future wage loss. The trial judge awarded $171,296.49 for Mr. Ho’s injuries and this included $60,000 for future loss of earnings capacity and $8,000 for future cost of care.
